Recruiters Terms and conditions

1. Introduction

Recruiters posting job advertisement/s on the Light Engineering Industries Association of South Africa (LEIA) website agree to be bound by the below terms and conditions (“Terms”). If you do not agree with these Terms, please do not use the Site for job postings.

 

2. Definitions

2.1 Company: refers to the owner and operator of the Site – LEIA.

2.2 User: refers to any individual or organisation or recruiter  posting a job advertisement on the Site.

2.3 Job Advertisement: refers to all content posted on the Site in relation to employment opportunities.

 

3. Assumed Authority 

3.1. By posting a job advertisement, the Recruiter confirms that:

3.1.1. They are the duly authorised representative of the organisation offering the position.

3.1.2. They have the legal capacity to be bound by Terms.

3.1.3. The job advertisement complies with all applicable employment and anti-discrimination laws.

 

4. Job Posting Requirements

4.1 Accuracy and Truthfulness: All information provided in the job advertisement must be accurate, up-to-date, and not misleading.

4.2 Non-Discrimination: Job postings must comply with all relevant legislation and must not discriminate on the basis of age, gender, race, disability, religion, or any other protected characteristic.

4.3 Compliance with Law: The contents the job advertisement must not breach any applicable laws or regulations.

 

5. Posting Process

5.1 Registration: Recruiters will be required to create an account and provide verifiable information before being permitted to post any job advertisement.

5.2. Submission: Job advertisements should be submitted through the designated submission form on the Site.

5.3. Approval: The Company reserves the right to review, approve or reject any job advertisement prior to publication on the Site.

 

6. Fees and Payment

6.1 Fee Structure: All applicable fees for job postings will be clearly indicated on the Site. Fees must be paid in full prior to the job advertisement being published. Fees are non-refundable upon the publication of the job advertisement.

 

7. Job Advertisement guidelines

7.1. All job advertisement may not contain:

7.1.1. Defamatory, obscene, or offensive content.

7.1.2 Any material that infringes on the intellectual property rights of third parties.

7.1.3 Content that promotes or incites violence, hatred, or illegal activities.

7.1.4 Any information that could be reasonably considered as a breach of privacy or confidentiality.

 

8. Intellectual Property

The Company will have a non-exclusive, royalty-free, perpetual licence to use, reproduce, display, and distribute the contents of all job advertisements solely for the purpose of promoting the job opportunity and operating the Site.

 

9. Indemnity

The recruiter agrees to indemnify, defend, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with their job advertisement or breach of these Terms.

 

10. Removal and Termination

10.1. Removal: The Company reserves the right to remove any job advertisement that violates these Terms or is deemed inappropriate at its sole discretion.

10.2 Termination: The Company may terminate your account and access to the Site if you breach these Terms or for any other reason deemed necessary.

 

11. Disclaimer and Limitation of Liability

11.1. Disclaimer: The job advertisements are provided on an “as is” basis. The Company does not guarantee the accuracy, reliability, or completeness of any job advertisement and disclaims any warranties, express or implied.

11.2. Limitation of Liability: The Company shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the Site or any job advertisement.

 

12. Amendments

The Company reserves the right to amend these Terms at any time. Continued use of the Site after any changes constitutes acceptance of the updated Terms. Users are advised to review the Terms periodically for any modifications.

 

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, and its courts shall have exclusive jurisdiction to the exclusion of the courts of any other country.
